You can expect the eviction process to take between 30 and 90 days from the day you file the unlawful detainer, also known the UD, to the day that the tenant actually leaves your property.

Typical attorney fees associated with a straight eviction will usually be between $1,500 and $2,500, depending on the attorney. Those fees should include things like filing the unlawful detainer, service processing, and any sheriff’s fees. Most clients want to know if that’s the total cost, and unfortunately, it’s not. There are some things that add to your eviction costs. 

If your tenant is avoiding the service processor, the eviction is prolonged. If you’re negotiating with a difficult personality, that also adds time. Tenants like to seek representation in order to prolong the eviction. Any time your attorney has to respond to their attorney or spend time in a settlement conference, additional hours of your attorney’s time will be billed to you. Don’t expect your tenant to pay any rent during the eviction process, either. That’s another cost to absorb.

Do your due diligence so you can avoid the cost and time an eviction takes. When you’re screening tenants, make sure you run your own credit report. Verify the tenant’s income, and talk to both current and former landlords. These things will help you out in the future with your tenants.
